The Court explains the purpose of today's hearing and provides background information regarding Case Numbers 2:15-cv-02366-MMD-EJY and 3:23-cv-00379-MMD-EJY. In addition to the Motion to Deem Defendants Vexatious (ECF No. 368) and Motion for Order to Show Cause (ECF No. 369 ), the Court has reviewed the Counterclaim (ECF No. 375) and the Lost Mail Certificate of Service (ECF No. 376).Mr. Willis advises the Court of when he received the Plaintiff's Motions (ECF Nos. 368, 369) and the Court's Minute Order filed 9/1/2023 (ECF No. 374) in Case Number 2:15-cv-02366-MMD-EJY. Mr. Willis further advises the reason for the delay in filing the responses to the Plaintiff's Motions. Mr. Willis responds to the Court's inquiries. The Court accepts the responses to the Motions. The Court is provided with and reviews the electronic copies of the Response to Emergency Motion for Order to Show Cause (ECF No. 377), Affidavit in Support of the ECF No. 377 Response (ECF No. 378), Response to the ECF No. 374 Minute Order (ECF No. 379), and Response to the Motion to Deem Defendants Vexatious Litigants (ECF No. 380) which were filed on the docket during this proceeding. Mr. Willis, Mr. Aldridge, and Mr. Garabedian present arguments to the Court. The Court recites findings as to Case Number 2:15-cv-002366-MMD-EJY. The Court will grant the Motion for Order to Show Cause (ECF No. 369) and Motion to Deem Defendants Clarence Moses Willis and Ernest C. Aldridge Vexatious Litigants (ECF No. 368). The Court finds Mr. Willis and Mr. Aldridge in contempt of the Court's prior orders. The Court agrees that sanctions for contempt should be imposed. The Court will grant reasonable fees incurred in connection to the Motion for Order to Show Cause and any work related to that Motion, including attending today's hearing. A written order will issue. The Court recites findings as to Case Number 3:23-cv-00379-MMD-EJY. The Motion to Stay Case (ECF No. #17 ) and Motion for Entry of Clerk's Default (ECF No. #26 ) are denied as moot. The Court agrees that sanctions for contempt should be imposed. The Court will grant reasonable fees incurred defending this case. The Court will sua sponte dismiss this case that was filed in clear contempt of the Court in Case Number 2:15-cv-002366-MMD-EJY. The Clerk of Court is directed to enter judgment in favor of Defendant Federal National Mortgage Association ("Fannie Mae") in Case Number 3:23-cv-00379-MMD-EJY. The action is dismissed with prejudice and the Clerk of Court is directed to close the case.IT IS ORDERED that Federal National Mortgage Association ("Fannie Mae") will file the Affidavit for Fees on or before seven (7) days from today's date.
