About the Santa Clara County Superior Court

The Santa Clara County Superior Court, or alternatively the Superior Court of California, County of Santa Clara, has jurisdiction over Santa Clara County and is one of the 58 Superior Courts in California. The county is home to a population of nearly 1.8 million and encompasses 1,321 square miles. Santa Clara County is one of the largest counties in California, following Los Angeles, San Diego, and Orange Counties.

In its mission statement, the Court states that it "serves the public by providing equal justice for all in a fair, accessible, effective, efficient, and courteous manner: by resolving disputes under the law; applying the law consistently, impartially, and independently; and by instilling public trust and confidence in the Court."

In order to fulfill its mission and to serve the residents of its county, the Superior Court of Santa Clara operates the following nine divisions out of seven different locations: Appellate, Civil, Collaborative Courts, Criminal, Family, Juvenile, Probate, Small Claim, and Traffic.

The Santa Clara County Superior Court currently has 77 judges and five commissioners. Additionally, the Court has Temporary ("pro tem") Judges who serve in a judicial capacity. A Temporary Judge is a lawyer who has volunteered to hear and decide cases.

Santa Clara County Superior Court Divisions

Appellate Division

The Appellate Division of the Santa Clara County Superior Court decides appeals in misdemeanor, traffic, and limited civil jurisdiction cases only.

Civil Division

The Civil Division handles civil matters, including civil harassment, contracts, and name changes, in the Downtown Superior Court, the Old Courthouse, and the South County Morgan Hill Courthouse.

Collaborative Courts Division

The Collaborative Courts Division address issues related to  substance abuse and mental health, connect participants to available community services, seek alternatives to incarceration and other forms of punishment, and reduce the chances of committing criminal offenses again.

For adults, the Collaborative Courts include the Criminal Court, Family Court, and Juvenile Dependency Court. The Collaborative Courts for youths include the Juvenile Justice Court.

Criminal Division

The Santa Clara County Superior Court Criminal Division handles cases related to minor offenses, such as traffic infractions, and serious offenses, like robbery and murder.

Criminal cases are heard at the Hall of Justice, the Family Justice Center Courthouse, the Palo Alto Courthouse, and the South County Morgan Hill Courthouse. Family Court Division

The Family Court Division handles divorce, legal separation, nullity, establishing parentage, restraining orders/domestic violence, child support, spousal support, family support, child custody and visitation, and mediation and arbitration matters.

Juvenile Division

The Juvenile Division handles cases involving children under the age of 18, who violate any law, or any children who are abused or neglected. Cases in which a child is accused of a crime are heard by the Juvenile Justice Department located at the Juvenile Justice Courthouse. Other cases, such as those where a parent or guardian is accused of abusing or neglecting a child, are heard by the Juvenile Dependency Department at the Family Justice Center Courthouse.

Probate Division

The Probate Division of the Santa Clara Superior Court deals with cases related to the transfer of property from people who have died, disputes about trusts, the appointment of a person to oversee the finances and/or the care of an older adult or a developmentally disabled adult who cannot take care of himself/herself, the appointment of a person to make certain mental health decisions for someone who is gravely disabled and is unable to care for his/her personal needs, challenges to quarantine orders, the appointment of a guardian, adoptions for children and adults, name change or gender change for adults and children, approval by the court of the terms of an agreement to settle a claim by a child, the freeing of a child from the control of a parent and the giving to the child of some rights as an adult, and establishing a fact of a birth or death or a marriage that has not been recorded or cannot be obtained.

Small Claim Division

The Small Claim Division handles small claims cases and is a special court in which disputes are resolved inexpensively and quickly.

Traffic Division

The Traffic Division addresses violations of traffic laws, minor offenses, and more serious automobile-related matters.
