About the San Bernardino County Superior Court

The San Bernardino County Superior Court, or alternatively the Superior Court of California, County of San Bernardino, is a court of general jurisdiction, serving the largest geographic county in the contiguous United States. San Bernardino County encompasses 20,105 square miles of California, or approximately 12% of the state’s total area. The county serves a population of over 2 million residents and is the 5th most populated county in California. The San Bernardino County Superior Court can hear matters relating to criminal felonies, juveniles, families, mental health, probate, traffic, and civil issues.

The SB Superior Court, headed by a Presiding Judge, is divided into multiple divisions, including Civil, Criminal, Family, Probate, Juvenile, Mental Health, and Traffic courts. Other divisions that exist to aid the public and the court system are Landlord/Tenant, Small Claims, and Appeals.

The Court’s mission statement is: “Our Court exists to preserve and protect rights and to effect fair resolutions of all disputes brought to the Court.”

Civil Division

The Civil Division of San Bernardino County Superior Court handles lawsuits involving a party suing another to recover money, real property or personal property, contracts or an obligations, damages for injury, also called torts, or the protection of some civil right.

Criminal Division

The San Bernardino County Superior Court Criminal Division has jurisdiction over misdemeanor and felony criminal charges. The Court conducts arraignments where accused individuals are informed of the specific charges against them and are advised of their rights. The Criminal Division also holds preliminary hearings on felony charges to determine if there is sufficient evidence to require a Defendant to stand trial.

Family Division

The Family Division handles actions involving Dissolution of Marriage (Divorce), Domestic Partnership, Legal Separation, Nullity, Paternity/Parentage, Guardianships, Child Custody and Visitation, Spousal and Child Support, Domestic Violence or Elder Abuse, and Adoptions.

Juvenile Division

The Juvenile Division of the SB Superior Court hears juvenile justice (delinquency) cases, where a youth is charged with an offense, and dependency cases, involving allegations of child abuse and neglect.

The Probate Division handles decedents’ estates, trusts, and conservatorships. The San Bernardino Civil/Probate Division is the only place that these matters are filed. The Probate Division also hears petitions to establish the facts of birth, death, and marriage as well as elder abuse petitions.
