On September, 13, 2021, Dolores Washick and Michael Washick (“Plaintiffs”), represented by John V. Petrycki of Mayfield, Turner, O'mara, Donnelly & Mcbride, PC, filed a personal injury lawsuit against Target Corporation, improperly pleaded as Target Stores (hereinafter “Target Corporation”) and ABC CORPS 1-10 (fictitious names of businesses and/or corporations which cannot be ascertained at this time) (collectively, “Defendants”), seeking compensatory damages of over $75,000.00 for personal injuries sustained by the Plaintiffs caused by the alleged negligence of the Defendants. This case was filed in U.S. District Court in the Southern District of New Jersey with Judge Renee Marie Bumb and Judge Karen M. Williams presiding.

 

The Complaint purports to assert a cause of action in negligence against defendant, Target Corporation, stemming from an incident that occurred on or about August 18, 2019. Plaintiff, Dolores Washick, alleged that she was an invitee at the Target store located in Mt. Laurel, New Jersey when she was caused to fall in the check-out aisle sustaining severe injuries.

 

In the complaint, the Plaintiffs alleged that, “she sustained severe personal injuries of both a permanent and temporary nature and has been and in the future be forced to endure great pain and suffering and has been and will in the future be forced to incur medical expenses in the care and treatment of said injuries.”

 

The Plaintiffs also alleged that, “Defendant’s investigation revealed that plaintiff fell forward onto her face sustaining a laceration to her face/head. Plaintiff counsel’s office advised pre-suit that Ms. Washick sustained a tear of her rotator cuff and was scheduled for surgery. They also advised that Ms. Washick broke some teeth and needed dental work. Therefore, it is reasonably believed that there is over seventy-five thousand dollars ($75,000.00) in controversy and the jurisdictional threshold under 28 U.S.C. § 1332(a) is satisfied.”

 

Further, the Plaintiffs alleged that, “Pursuant to 28 U.S.C. § 1446(a) and Local Rule 5.1(e), a true and correct copy of all of the process, pleadings, orders, and documents from the State Court Action which have been served upon defendant Target Corporation are being filed with this Notice of Removal,”.

 

The only claim for relief by the Plaintiffs is for personal injuries suffered by them due to the alleged negligence of Defendants.

 

In the prayer for relief, the Plaintiffs have requested the Court to pass an order for compensatory damages of over seventy-five thousand dollars ($75,000.00) under 28 U.S.C. § 1332(a) and such other relief as the Court deems just and proper.
