On November 24, 2021, Vanara Taing (“Plaintiff” or “Ms. Taing”), represented by Kelsey Marie Schultz, Scott A. Burroughs and Stephen M. Doniger of Doniger Burroughs, filed an intellectual property lawsuit against Logan Industry, LLC (“Logan Industry”), Logan Content, LLC (“Logan Content”), TDK Documentary, LLC (“TDK”), Scott Free Productions, INC. (“Scott Free”), Does 1 through 10 and Ors. (collectively, “Defendants”), seeking injunctive relief and costs along with pre-and post-judgement interest for the Defendants’ alleged infringement of the Plaintiff’s United States Copyright. This case was filed in U.S. District Court in the Central District of California with Judge Michael W. Fitzgerald and Judge Patricia Donahue presiding.

 

The Plaintiff filed this complaint for the alleged infringement of United States Copyright i.e., Ms. Taing’s original documentary film, “the business of family.” owned by the Plaintiff.

 

In their complaint, the Plaintiff alleged that, “Ms. Taing shot “the business of family” over the course of four days to ensure that she captured all the work her family performed within 24 hours of operating their donut shop. She also conducted extensive interviews with her Uncle and Grandfather regarding their family history, including why her Grandfather chose to purchase the donut business and their personal reflections. After making “the business of family”, Ms. Taing applied for graduate study at the American Film Institute Conservatory (“AFI”). Ms. Taing was awarded a “Paul & Daisy Soros Fellowship for New Americans,” a $90,000 merit-based fellowship exclusively for immigrants and children of immigrants who are pursuing graduate school in the United States.”

 

The Plaintiff further alleged that, “Ms. Taing uploaded “the business of family” to her account on the publicly accessible website https://www.vimeo.com (Ms. Taing’s “Vimeo Page”) for potential employers to view on August 13, 2009. Ms. Taing has not authorized Defendants to copy, reproduce, duplicate, disseminate, distribute, or create derivative works of the "the business of family.” In or about June of 2021, Ms. Taing watched “The Donut King” and discovered Defendants’ infringement of “the business of family.” Despite learning that “The Donut King” was infringing the copyrights in and to Ms. Taing’s “the business of family” in July of 2021, LOGAN INDUSTRY, LOGAN CONTENT, and TDK have not ceased reproduction and distribution of the Infringing Content by HULU, AMAZON, APPLE, and The Public Broadcasting Service.”

 

The Plaintiff also alleged that, “Plaintiff alleges on information and belief that Defendants, and each of them, infringed Plaintiff’s copyrights by creating infringing derivative works from “the business of family” and publishing same to the public. Due to Defendants’ acts of copyright infringement as alleged herein, Defendants, and each of them, have obtained direct and indirect profits they would not otherwise have realized but for their infringement of Plaintiff’s rights in the "the business of family.”

 

There are four claims for relief laid down by the Plaintiff. The first claim alleged deals with Copyright Infringement. The second claim alleged deals with vicarious and/or contributory Copyright Infringement. The third and fourth claims alleged deal with violations of 17 U.S.C. §1201.

 

In her prayer for relief, the Plaintiff requested that the Court enjoin the Defendants from infringing Plaintiff’s copyrights in the "the business of family", that the Plaintiff be awarded all the Defendants’ profits, that a constructive trust be entered over any revenues or other proceeds realized by Defendants and that the Plaintiff be awarded her attorneys’ fees and pre-judgement interest.
