On June 14, 2021, Torvent LLC (“Torvent” or “Plaintiff”), represented by Ronald P. Golden, III and Stephen B. Brauerman of Bayard, P.A., filed an intellectual property lawsuit against Techtronic Industries Co., Ltd.; Techtronic Industries North America, Inc.; One World Technologies, Inc.; Homelite Consumer Products, Inc.; Hart Consumer Products, Inc. (collectively, “TTi”) and Others, (collectively, the “Defendants”), seeking preliminary and permanent injunction and damages among other reliefs for allegedly infringing one or more claims of the Asserted Patents of the Plaintiff. This case was filed in the U.S. District Court in the District of Delaware.

 

The Plaintiff filed this complaint for the alleged infringement of United States Patent No. 8,025,249 (the “’249 Patent”); United States Patent No. 9,516,807 (the “’807 Patent”); United States Patent No. 9,924,631 (the “’631 Patent”); United States Patent No. D814,893 (the “’D893 Patent”); United States Patent No. D598,255 (the “’D255 Patent”); and United States Patent D598,254 (the “’D254 Patent”), (collectively, the “Patents-in-suit”) owned by them. 

 

In the complaint, the Plaintiff has alleged that, “Each of TTi, Home Depot, and Walmart has directly infringed the claim of the ’D893 Patent by making, importing, using, offering for sale, and/or selling some or all of the Accused 3rd and 4th Generation Products in the United States all in violation of 35 U.S.C. § 271(a).”

 

Further, the Plaintiff alleged that, “The spool found in each of the Accused 3rd and 4th Generation Products are not materially different and both infringe the claim of the ’D893 Patent.” And they further alleged that “TTi-HK while knowing of the ’D893 Patent made or had made the Accused 3rd and 4th Generation Products in China, and sold or otherwise transferred the Accused 3rd and 4th Generation Products to TTi-US intending that such products would be imported, offered for sale, and/or sold in the United States by TTi-US, and knowing that such acts by TTi-US constituted direct infringement of the ’D893 Patent under 35 U.S.C. § 271(a).”

 

Similar allegations have been made by the Plaintiff with reference to the infringement of other five Patents-in-suit. 

 

There are six causes of action laid down by the Plaintiff, one for the alleged infringement of each of the Patents-in-suit.



In its prayer for relief, the Plaintiff has requested the Court to declare that Defendants have infringed the patents-in-suit, grant preliminary and permanent injunctive relief against each of the Defendant, award damages to the Plaintiff in an amount to be proven at trial, but in no event less than any reasonable royalty for infringement of the ’D893 and/or ’D254 and/or ’D255 Design Patents. The plaintiff also requested damages including prejudgement and post judgement interest and enhanced damages up to treble damages for each of the Defendants’ willful act of infringement under 35 U.S.C. §284. The Plaintiff also requested for attorneys’ fee under 35 U.S.C. §285 and any other relief that the court deems just and proper.
