Case Summary

On September 3, 2021, Power2B, Inc. (Power2B or “Plaintiff”), represented by Jason Aaron Wietjes of Polsinelli PC filed an intellectual property lawsuit against Samsung Electronics Co., Ltd. (SEC) and Samsung Electronics America, Inc. (SEA) (collectively, Samsung or “Defendants”). Plaintiff filed suit seeking injunctive relief, monetary damages, pre-judgment and post-judgment interest and such other relief for the alleged infringement of the United States Patent owned by the Plaintiff. This case was filed in the United States District Court in the Eastern District of Texas.

 

This is an original complaint for alleged patent infringement pursuant to 35 U.S.C. §§ 100 et seq. Power2B alleges that Samsung infringes one or more claims of patents owned by Power2B: United States Patent No. 7,952,570 entitled “Computer Navigation” (’570 patent), United States Patent No. 8,547,364 entitled “Input System for Controlling Electronic Device” (’364 patent), United States Patent No. 8,816,994 entitled “Input System for Controlling Electronic Device” (’994 patent), United States Patent No. 9,946,369 entitled “Input System for Controlling Electronic Device” (’369 patent), United States Patent No. 10,664,070 entitled “Input System for Controlling Electronic Device” (’070 patent) (collectively, the Asserted Patents).

 

In the complaint, the plaintiff alleged that, “Samsung has engaged and continues to engage in a pattern of conduct intended to induce and/or contribute to the infringement of others, such as its customers and end-users. These actions have included and include making, selling, offering to sell, and/or importing products that infringe the Asserted Patents.”

 

The plaintiff also alleged that, “There is an actual, substantial, and continuing justiciable controversy between Power2B and Samsung regarding Samsung’s infringement of the Asserted Patents. Absent a judgment and injunction from this Court, Samsung will continue to infringe the Asserted Patents and cause damage and irreparable harm to Power2B.”

 

Further, the plaintiff alleged that, “Despite being aware and having knowledge of Power2B’s patents, and recognizing the value and benefits of Power2B’s patented technology, Samsung has elected to infringe the Asserted Patents, including by incorporating Power2B’s technology into at least the Accused Products.”

 

Plaintiff has made similar claims with reference to the infringement of the other Asserted Patents.

 

There are five claims for relief laid down by the plaintiff, one for infringement of each Asserted Patents.

 

In the prayer for relief, the plaintiff has requested the court to pass a judgment that Samsung has infringed, either literally and/or under the doctrine of equivalents, each of the Asserted Patents along with a permanent injunction including damages, costs, expenses, an accounting, and enhanced damages. The plaintiff further requests the court pass a judgment for Samsung to pay Power2B supplemental damages, including without limitation, pre-judgment and post-judgment interest. The plaintiff also requested the court to pass an order finding this to be an exceptional case and awarding attorneys’ fees as provided by 35 U.S.C. § 285 and such other and further relief as the court deems just and proper.
