Case Summary

On September 13, 2021, Parallel Networks Licensing, LLC (“Parallel Networks” or “Plaintiff”), represented by James M. Lennon of Devlin Law Firm LLC, filed an intellectual property lawsuit against Arrow Electronics, Inc. (hereinafter, “Arrow” or “Defendant”), seeking monetary damages and such other relief for the alleged infringement of the United States Patent owned by the Plaintiff. This case was filed in U.S. District Court in the Eastern District of Texas with Judge Amos L. Mazzant, III presiding.

 

This is an action for alleged patent infringement, arising under the Patent Laws of the United States, 35 U.S.C. § 1 et seq. by the Defendant, of the United States Patent No. 5,894,554 entitled “System for managing dynamic web page generation requests by intercepting request at Web server and routing to page server thereby releasing web server to process other requests” (“the ’554 Patent”) and United States Patent No. 6,415,335 (“the ’335 patent”) (collectively, “the Asserted Patents”).

 

In the complaint, the Plaintiff alleged that, “Upon information and belief, Defendant has directly infringed one or more claims of the ’554 Patent by using, and/or providing and causing to be used products, specifically one or more servers that may load-balance among other servers, which by way of example, includes Defendant’s use of A10’s A10 Lightning ADC, and/or Thunder ADC products, or the use of a web server in conjunction with the same (the “Accused Instrumentalities”).”

 

The Plaintiff also alleged that, “Upon information and belief, Defendant has directly infringed at least claim 12 of the ’554 patent by its use of A10 Lightning ADC (Application Delivery Controller) and Thunder ADC line (which both can managed, for example, using the A10 Harmony controller, or by use of a web server in conjunction with the same.”

Further, the Plaintiff alleged that, “Upon information and belief, each Defendant has directly infringed one or more claims of the ’335 Patent by using, and/or providing and causing to be used products, specifically one or more servers that may load-balance among other servers, which by way of example, includes Defendant’s use of A10 Lightning ADC, and/or Thunder ADC products, or the use of a web server in conjunction with the same (the “Accused Instrumentalities”).” And that, “Upon information and belief, Defendant has directly infringed at least claim 43 of the ’335 patent by its use of A10 Lightning ADC, and/or Thunder ADC products, or by use of a web server in conjunction with the same.”

 

There are two claims for relief laid down by the Plaintiff, one for the alleged infringement of each of the Asserted Patents.

 

In the prayer for relief, the Plaintiff has requested the Court to pass a judgment adjudicating that Defendant has infringed the ’554 and ’335 Patents along with an award of damages, including interest, costs, expenses and an accounting of all infringing acts. The Plaintiff also requested the Court to declare this an exceptional case within the meaning of 35 U.S.C. § 285 and provide attorneys’ fees, expenses, and costs incurred in this action and such other and further relief as the Court deems just and proper.
