Moxchange LLC v. Electrolux Home Products, Inc.

Case Summary

On August 25, 2021, Moxchange LLC (“Plaintiff”), represented by Jimmy C. Chong of The Chong Law Firm, P.A., filed an intellectual property lawsuit against Electrolux Home Products, Inc. (“Defendant”), seeking damages and costs along with prejudgment and post-judgement interest among other relief for the alleged infringement of the United States Patent owned by the Plaintiff. This case was filed in the United States District Court in the District of Delaware.

 

The Plaintiff filed this complaint for the alleged infringement of the United States Patent No. 7,233,664 (“the ‘664 Patent” or “Patent-in-suit”) owned by the Plaintiff. 

 

In the complaint, the Plaintiff alleged that, “Upon information and belief, Defendant has been directly infringing claim 1 of the ‘664 patent in Delaware, and elsewhere in the United States, by performing actions comprising using or performing the claimed method of providing secure authentication between wireless communication network nodes by using and/or testing the Electrolux.” 

 

Further, the Plaintiff alleged that, “Plaintiff has been damaged as a result of Defendant’s infringing conduct. Defendant is thus liable to Plaintiff for damages in an amount that adequately compensates Plaintiff for such Defendant’s infringement of the ‘664 patent, i.e., in an amount that by law cannot be less than would constitute a reasonable royalty for the use of the patented technology, together with interest and costs as fixed by this Court under 35 U.S.C. § 284.” 

 

The Plaintiff also alleged that, “Defendant has had at least constructive notice of the ‘664 patent by operation of law and, to the extent required, marking requirements have been complied with” and “On information and belief, Defendant will continue its infringement of one or more claims of the ‘664 patent unless enjoined by the Court. Defendant’s infringing conduct thus causes Plaintiff irreparable harm and will continue to cause such harm without the issuance of an injunction.” 

 

There is one claim for relief laid down by the Plaintiff, for the alleged infringement of the Patent-in-suit.

 

In the prayer for relief, the Plaintiff has requested the Court for judgement that one or more claims of United States Patent No. 7,233,664 have been infringed, either literally and/or under the doctrine of equivalents, by the Defendant; that the Defendant account for and pay to the Plaintiff all damages to and costs incurred by the Plaintiff because of the Defendant’s infringing activities and other conduct complained of herein; that the Defendant be enjoined from future infringing activities along with pre-judgement and post-judgement interest on the damages caused by Defendant’s infringing activities and other conduct complained of herein and any other relief the Court deems just and proper.
