Case Summary

Linfo IP, LLC (“Linfo” or “Plaintiffs”), represented by William P. Ramey, III of Ramey & Schwaller, LLP, filed an intellectual property lawsuit against Home Depot U.S.A., Inc. D/B/A The Home Depot (“Home Depot'' or “Defendant”), seeking injunctive relief, monetary damages prejudgment and post-judgment interest and other relief for the alleged infringement of the United States Patent owned by the plaintiff. This case was filed in the United States District Court in the Western District of Texas with Judge Alan D. Albright presiding.

 

This is an action for patent infringement by Defendant of the United States Patent which generally relates to novel and improved methods and apparatuses for conducting electronic commerce: United States Patent No. 9,092,428 entitled “System, methods and user interface for discovering and presenting information in text content” (“the ‘428 patent”) (referred to as the “Patent-in-Suit”).

 

In the complaint, the plaintiff alleged that, “Home Depot maintains, operates, and administers systems that facilitate discovering and presenting information in text content with different view formats that infringes one or more claims of the ‘428 patent, including one or more of claims 1-20, literally or under the doctrine of equivalents.”

 

The plaintiff also alleged that, “Home Depot has and continues to induce infringement. Home Depot has actively encouraged or instructed others (e.g., its customers and/or the customers of its related companies), and continues to do so, on how to use its products and services (e.g., discovering and presenting information in text content with different view formats) such as to cause infringement of one or more of claims 1–20 of the ‘428 patent, literally or under the doctrine of equivalents. Moreover, Home Depot has known of the ‘428 patent and the technology underlying it from at least the date of issuance of the patent.”

 

Further, the plaintiff alleged that, “Home Depot has and continues to contributorily infringe. Home Depot has actively encouraged or instructed others (e.g., its customers and/or the customers of its related companies), and continues to do so, on how to use its products and services (e.g., discovering and presenting information in text content with different view formats) and related services such as to cause infringement of one or more of claims 1–20 of the ‘428 patent, literally or under the doctrine of equivalents. Moreover, Home Depot has known of the ‘428 patent and the technology underlying it from at least the date of issuance of the patent.”

 

There is only one claim for relief laid down by the plaintiff for infringement of the Patent-in-suit.

 

In the prayer for relief, the plaintiff has requested the court to pass a judgment that Defendant has infringed the claims of the ‘428 patent along with permanent injunctive relief and damages in an amount sufficient to compensate for Defendant’s infringement of the ‘428 patent in an amount no less than a reasonable royalty or lost profits, together with prejudgment and post-judgment interest and costs under 35 U.S.C. § 284. The plaintiff also requested the court to pass an award of additional damage and treble the damages, including attorneys’ fees, expenses, and costs incurred in this action and an increase in the damage award pursuant to 35 U.S.C. § 284 and such other and further relief as the court deems just and proper.
