Case Summary

On February 26, 2021, Coretek Licensing LLC (“Plaintiff” or “Coretek”), represented by Jimmy C. Chong of The Chong Law Firm, P.A. filed an intellectual property lawsuit against Discord Inc. (“Defendant”), seeking injunctive relief, damages among other reliefs for allegedly infringing Coretek’s intellectual property relating to Method of Enabling a Wireless Device to Make a Network Connection Without Using a Network Operator’s Home Location Register and various other technologies. This case was filed in U.S. District Court in the District of Delaware with Judge Christopher J. Burke and Maryellen Noreika presiding.

 

The Plaintiff alleged that the Defendants have infringed one or more claims under United States Patent Numbers 8,861,512 entitled “Method of Enabling a Wireless Device to Make a Network Connection Without Using a Network Operator’s Home Location Register” (“the ‘512 Patent”), 9,173,154 entitled “Method of Enabling a Wireless Device to Make a Network Connection WIthout using a Network Operator’s Home Location Register” (“the ‘154 Patent”), 9,369,575 entitled “Dynamic VOIP Location System” (“the ‘575 Patent”), and 9,591,551 entitled “Method of Enabling a Wireless Device to Make a Network Connection Without Using a Network Operator’s Home Location Register” (“the ‘551 Patent”) owned by Coretek (collectively the “Patents-in-Suit”).

 

Plaintiff alleged that “Defendant has directly infringed and continues to directly infringe at least one claim of the ‘512 Patent, the ‘154 Patent, the ‘575 Patent, and the ‘551 Patent by using, at least through internal testing or otherwise, the Accused Product without authority in the United States, and will continue to do so unless enjoined by this Court. As a direct and proximate result of Defendant’s direct infringement of the ‘512 Patent, the ‘154 Patent, the ‘575 Patent, and the ‘551 Patent, Plaintiff has been and continues to be damaged”.

 

Plaintiff further alleged that “Defendant has induced others to infringe the ‘512 Patent, the ‘154 Patent, the ‘575 Patent, and the ‘551 Patent by encouraging infringement, knowing that the acts Defendant induced constituted patent infringement, and its encouraging acts actually resulted in direct patent infringement” and that “Defendant has committed these acts of infringement without license or authorization.”



Four claims for relief laid down by the Plaintiff are for the alleged infringement of one or more claims of the ‘512 Patent, ‘154 Patent, the ‘575 Patent and ‘508 Patent respectively.

 

In the prayer for relief, Plaintiff has requested the court to pass an order that Defendant has infringed the ‘512 Patent, the ‘154 Patent, the ‘575 Patent, and the ‘551 Patent either literally or under the doctrine of equivalents, order an accounting of all infringing sales and damages, that Defendant be permanently restrained and enjoined from directly infringing the ‘512 Patent, the ‘154 Patent, the ‘575 Patent, and the ‘551 Patent. Plaintiff further requested the court to award Plaintiff damages pursuant to 35 U.S.C. §284, order an assessment of pre-judgment and post-judgment interest and costs against Defendant, together with an award of such interest and costs, in accordance with 35 U.S.C. §284 along with costs of action.
