Case Summary

On September 16, 2021, Callstat Solutions LLC (“Plaintiff” and/or “Callstat”), represented by David W. deBruin of Gawthrop Greenwood, PC, filed an intellectual property lawsuit against Zoom Video Communications, Inc. (“Defendant” and/or “Zoom”), seeking damages and reasonable attorney’s fees along with other relief for the alleged infringement of United States Patent owned by the Plaintiff. This case was filed in the U.S. District Court in the District of Delaware.

 

The Plaintiff filed this complaint for the alleged infringement of United States Patent No. 6,243,452 (“the ‘452 Patent”) entitled “Graphical call status presentation system,” (referred to as the “Patent-in-Suit”) owned by the Plaintiff.

 

In the complaint, the Plaintiff alleged that, “Defendant directly infringed one or more claims of the ’452 Patent in at least this District by making, using, offering to sell, selling and/or importing, without limitation, at least the Defendant products identified in the charts incorporated (among the “Exemplary Defendant Products”) that infringed at least the exemplary claims of the ’452 Patent also identified in the charts incorporated into this Count below (the “Exemplary ’452 Patent Claims”) literally or by the doctrine of equivalents. On information and belief, numerous other devices that infringed the claims of the ’452 Patent have been made, used, sold, imported, and offered for sale by Defendant and/or its customers.”

 

The Plaintiff also alleged that, “Defendant also directly infringed, literally or under the doctrine of equivalents, the Exemplary ’452 Patent Claims, by having its employees internally test and use these Exemplary Products. Exhibit 2 includes charts comparing the Exemplary ’452 Patent Claims to the Exemplary Defendant Products. As set forth in these charts, the Exemplary Defendant Products practice the technology claimed by the ’452 Patent. Accordingly, the Exemplary Defendant Products incorporated in these charts satisfy all elements of the Exemplary ’452 Patent Claims. Plaintiff is entitled to recover damages adequate to compensate for Defendant's infringement.”

 

There is only one claim for relief laid down by the Plaintiff, for alleged infringement of the Patent-in-Suit.

 

In its prayer for relief, the Plaintiff has requested the Court for a judgment that the ’452 Patent is valid and enforceable, a judgment that the Defendant has infringed directly one or more claims of the ’452 Patent, an accounting of all damages not presented at trial, a judgment that awards the Plaintiff all appropriate damages under 35 U.S.C. § 284 for the Defendant's past infringement at least with respect to the ’452 Patent, an accounting that this case be declared exceptional within the meaning of 35 U.S.C. § 285 and that the Plaintiff be awarded its reasonable attorney’s fees against the Defendant that it incurs in prosecuting this action, an accounting that the Plaintiff be awarded costs, and expenses that it incurs in prosecuting this action along with such further relief at law or in equity as the Court deems just and proper.
