Case Summary

On August 3, 2021, Blitzsafe Texas, LLC (“Blitzsafe” or “Plaintiff”), represented by Alfred Ross Fabricant, Justine Minseon Park, Peter Lambrianakos and Vincent J Rubino, III of Fabricant LLP, filed an intellectual property lawsuit against Harley-Davidson Motor Company, Inc. (“Harley-Davidson” or “Defendant”), seeking permanent injunctive relief, damages and attorneys’ fees and costs pursuant to 35 U.S.C. § 285 for the alleged infringement of the United States Patents owned by the Plaintiff. This case was filed in U.S. District Court in the Eastern District of Texas with Judge Rodney Gilstrap presiding.

 

The Plaintiff filed the complaint for the alleged infringement of the United States Patents which generally cover systems for integrating third-party audio devices and multimedia devices with a car stereo: U.S. Patent No. 7,489,786 entitled “Audio Device Integration System” (the “’786 Patent”); U.S. Patent No. 8,155,342 entitled “Multimedia Device Integration System” (the “’342 Patent”) (together, the “Patents-in-Suit”).

 

In the complaint, the Plaintiff alleged that, “Defendant has and continues to directly infringe one or more claims of the ’786 Patent, including claim 57, either literally or under the doctrine of equivalents, by making, using, offering to sell, selling, and/or importing into the United States infringing Infotainment Systems without authority and in violation of 35 U.S.C. § 271.”

 

The Plaintiff also alleged that, “Defendant has and continues to indirectly infringe one or more claims of the ’786 Patent by knowingly and intentionally inducing others to directly infringe, either literally or under the doctrine of equivalents, by making, using, offering to sell, selling, and/or importing into the United States the infringing Infotainment Systems.”

 

Further, the Plaintiff alleged that, “Defendant has and continues to indirectly infringe one or more claims of the ’786 Patent by contributing to the direct infringement, either literally or under the doctrine of equivalents, by others, including automotive OEMs and end-users, by offering to sell, selling, and/or importing into the United States the infringing Infotainment Systems, with the knowledge that, at least as of the date of this Complaint, the Infotainment Systems contain components that constitute a material part of the inventions claimed in the ’786 Patent.”

 

Similar allegations have been made by the Plaintiff with reference to the  other Patents in suit.

 

There are two claims for relief laid down by the Plaintiff, one for the alleged infringement of each of the Patents-in-suit.

 

In their prayer for relief, the Plaintiff has requested that the Court pass an order declaring Defendant’s infringement of the Patents-in-Suit has been willful and deliberate along with permanent injunctive relief pursuant to 35 U.S.C. § 283 with an award of damages together with together with interest and costs. The Plaintiff also requested that the Court award treble damages pursuant to 35 U.S.C. § 284 and declare this as an exceptional case and award Plaintiff costs, expenses and reasonable attorney fees, pursuant to 35 U.S.C. §§ 285.
