ARANJO v. TARGET CORPORATION et al

Case Summary

On November 19, 2021, Nancy Aranjo (“Plaintiff”), represented by Michael E. Ellery of Console and Associates P.C., filed a personal injury lawsuit against Target Corporation, John Does #1-10 and ABC Corporation # 1-10 (collectively, “Defendants”),  seeking damages, interests and costs for personal injuries caused to the Plaintiff due to the Defendant’s alleged negligence and carelessness. This case was filed in U.S. District Court in the Southern District of New Jersey with Judge Claire C. Cecchi and Judge Andre M. Espinosa presiding

The Plaintiff brings this action for the injuries and damages suffered by the Plaintiff that alleged resulted from the Defendants’ action or failure to act to cure the hazardous condition or warn of the hazardous condition.

In their complaint, the Plaintiff alleged that, “Despite knowing of the hazardous condition, defendants neither fixed the  hazardous condition, nor warned of its existence.  As a result of defendant’s negligence and carelessness, Plaintiff sustained injuries and damages that directly resulted from defendant’s actions or failure to act.”

The Plaintiff further alleged that, “As a direct and proximate result of the acts and/or omissions of defendant Target Corporation, the Plaintiff, Nancy Aranjo sustained severe and permanent personal injuries, mental anxiety and anguish, a severe shock to her entire nervous system and other injuries, the full extent of which are not yet known.”

The Plaintiff also alleged that, “As a direct and proximate result of the acts and/or omissions of defendant Target Corporation, Plaintiff, Nancy Aranjo has been and will continue to be compelled to spend large sums of money for medical care in an effort to cure herself of the injuries from which she has suffered and will continue to suffer as a result of this accident.”

The three claims for relief laid down by the Plaintiff are for the alleged negligence and carelessness of the Defendants, wherein it has been claimed that the negligence and carelessness of the defendants consisted of failing to keep the premises in a safe condition; failing to exercise proper care in maintaining the premises; causing and permitting a dangerous and hazardous condition to exist; permitting a nuisance to exist; failing to provide proper, safe and clear access and usage for all persons allowed, permitted and invited to use the premises; failing to provide proper safeguards and/or warnings on the premises; failing to properly secure and remedy the hazardous condition; failing to properly train and instruct its employees concerning proper maintenance and safety of the premises; and acting otherwise negligent in the use, operation, maintenance and control of the premises.

In their prayer for relief, the Plaintiff has requested the Court for a judgment in her favor and against defendant Target Corporation for damages in excess of $75,000.00, exclusive of interest and costs.
