(#15) OPINION AND ORDER re: 9 MOTION for Judgment on the Pleadings . filed by Madeleyne Guerrero, 11 MOTION for Judgment on the Pleadings . filed by Carolyn W. Colvin. Again, the Court notes that the ALJs decision may have be en substantively correct, but the process by which he arrived at the decision was flawed. Because of the criticality of Dr. Taverass opinion to Plaintiffs claims for SSI and DIB, the ALJ was obligated to seek out evidence to resolve the seeming contr adiction in Dr. Taverass statements, rather than reflexively to discount Dr. Taverass opinion as unworthy of reliance. For all of the foregoing reasons, Plaintiffs motion for judgment on the pleadings is GRANTED; the Defendants motion for judgment on the pleadings is DENIED.
