Rulings:Matter on calendar for Wednesday, February 24, 2021, Line 6, Petitioner Debra Abney's Motion For Writ Of Mandamus (CCP 1094.5):Petitioner's "motion for writ of mandamus" as to the fourth cause of action is denied without prejudice to petitioner bringing a motion that would entirely dispose of the petition, which contains four causes of action. A hearing on a petition for writ of mandamus is the functional equivalent of a trial and results in a final judgment. (See Code Civ. Proc. sec. 1094.5(f) ["The court shall enter judgment either commanding respondent to set aside the order or decision, or denying the writ."]; Code Civ. Proc. sec. 577 ["A judgment is the final determination of the rights of the parties in an action or proceeding."]; see also Code Civ. Proc. secs. 1090 [on petition for writ of traditional mandamus, if return raises a question of fact, the court may order the question to be tried before a jury], 1092 ["The motion for new trial must be made in the court in which the issue of fact is tried"].) Just as a court will not hold a trial on one cause of action of a multi-cause of action complaint without a bifurcation order, the Court will not entertain a piecemeal adjudication of the petition.As a result of the COVID-19 emergency, all attorneys and parties are required to appear remotely. Hearings will be conducted by videoconference using Zoom. To appear at the hearing, go to the court's website at sfsuperiorcourt.org under "Online Services," navigate to "Tentative Rulings," and click on the appropriate link, or dial the corresponding phone number.Any party who contests a tentative ruling must send an email to contestdept302tr@sftc.org with a copy to all other parties by 4pm stating, without argument, the portion(s) of the tentative ruling that the party contests.
