27. Also pursuant to Civil Code section 1060, Plaintiff also contends that various provisions are ambiguous and are therefore either unenforceable or that the court is called upon to interpret and give meaning to so that plaintiff and the class may understand their own and their landlords’ and agent’s obligations under the contract. 28. Pursuant to Civil Code section 1060, as to the illegal or otherwise unenforceable provisions, Plaintiff and the class seek declaratory judgment determining the terms legality or ambiguity or the court’s interpretation and injunctive relief, if any, prohibiting Defendants from exploiting and/or enforcing these provisions by informing all past and present tenants of their illegality, unenforceability or meaning and removing, advising or correcting them in future leases. 29. Plaintiffs have incurred and, during the pendency of this action will incur expenses for attorney's fees and costs herein. Such attorney's fees and costs are necessary for the prosecution of this action and will result in a benefit to each member of the class or classes and the public at large and are thus awardable under Civil Code section 1021.5,

PRAYER

WHEREFORE, plaintiffs pray for judgment against each Defendants as follows: 1. A Declaratory judgment stating the respective rights and duties of the parties and/or the legality, unenforceability or meaning of the lease provisions in dispute; 2. An injunction, enjoining the acts and omissions alleged; 3. Attorney’s fees per the Contract, Code of Civil Procedure 1021.5, the catalyst, private attorney general, common fund or all other legal bases; and costs; and

4. Such other and further relief as the court deems proper.
