[TENTATIVE] ORDER RE: MOTION TO SUBSTITUTE SUCCESSOR-IN-INTEREST FOR PLAINTIFF

Plaintiff Vicky McCloud filed this action on October 31, 2017 against Defendants A and P Couteau, Inc. and Bharpour-Gagandeep Dhanoa Trust arising from an October 31, 2015 injury. On September 15, 2020, Plaintiff passed away. Plaintiff’s sister, Cheryl A. Pugh, seeks to be substituted as Plaintiff’s successor-in-interest. Defendant A and P Coteau, Inc. only objects to certain portions of Plaintiff’s counsel’s declaration which are immaterial to the motion. There is no opposition brief.
“A cause of action that survives the death of the person entitled to commence an action or proceeding passes to the decedent’s successor in interest . . . and an action may be commenced by the decedent’s personal representatives or, if none, by the decedent’s successor in interest.” (Code Civ. Proc., § 377.30.) After the death of a plaintiff, the court, on motion, shall allow a pending action that does not abate to be continued by the decedent’s personal representative or successor-in-interest. (Code Civ. Proc., § 377.31.)
The person who seeks to commence or continue a pending action as the decedent’s successor-in-interest shall execute and file an affidavit or declaration stating: (1) the decedent’s name, (2) the date and place of decedent’s death, (3) “No proceeding is now pending in California for administration of the decedent’s estate,” (4) a copy of the final order showing the distribution of the decedent’s cause of action to the successor-in-interest, if the decedent’s estate was administered, (5) either the affiant or declarant is the decedent’s successor in interest or the affiant or declarant is authorized to act on behalf of the decedent’s successor in interest, with facts in support thereof, (6) “No other person has a superior right to commence the action or proceeding or to be substituted for the decedent in the pending action or proceeding,” and (7) the statements are true, under penalty of perjury. (Code Civ. Proc., § 377.32.)
Ms. Pugh submits the required declaration under penalty of perjury. The Motion is GRANTED.

[TENTATIVE] ORDER RE MOTION TO COMPEL FURTHER RESPONSES
On June 5, 2019, Defendant A-P Couteau Inc. Bharpur-Gagandeep DH propounded supplemental interrogatories on Plaintiff Vicky McCloud. On December 17, 2019, Defendant filed a motion to compel further responses to the supplemental interrogatories. On January 14, 2020, the parties participated in an informal discovery conference and agreed that Plaintiff would provide further responses by January 24, 2020. Plaintiff never provided those further responses, and so Defendant proceeded with this motion. Plaintiff did not file an opposition to this motion.
The supplemental interrogatories requested updates to previous form and special interrogatory responses. Plaintiff responded she had no further responses or amendments to her responses. The responses to form interrogatory Nos. 6.4, 6.5, 6.6 continued many instances where Plaintiff stated “To be determined” in response to a questions about the charges to date for health care providers. At this point, two years and three months after filing this action, Plaintiff should know the costs to date for her medical treatment. According, the motion to compel as to form interrogatories is GRANTED.
Special interrogatory No. 10 asked for the last date Plaintiff received treatment by a health care provider as a result of injuries from the incident. Plaintiff did not provide a date. The motion to compel as to No. 10 is GRANTED.
Plaintiff is to provide further responses within 20 days of the date of this order.
Defendant seeks sanction against Plaintiff and her counsel. The Court GRANTS the request and imposes sanctions against Plaintiff and her counsel, jointly and severally, in the amount of $1,145, to be paid with 20 days of the date of this order.
