TENTATIVE RULING:
Defendants R.E. Gardinier Jr. Design + Construction, Inc. and Robert E. Gardinier’s UNOPPOSED Motion for Leave to File Cross-Complaint is GRANTED.
Defendants seek leave to file a Cross-Complaint against David Kenneth Wysong d/b/a ATH Construction (“Wysong”) and Hazie Lazarof d/b/a Hazie Lazarof Tile and Stone (“Lazarof”). Defendants seek to assert claims of indemnity and contribution against Wysong and Lazarof because they are allegedly responsible for the construction defects about which plaintiff complains. These claims are compulsory because they arise out of the renovation of the subject property alleged in the First Amended Complaint. (See CCP §§ 426.10(c), 426.30(a); First Amended Compl. ¶¶ 17, 19, 51 [defendants allegedly charged with paint, carpet, and wall covering portions of project], ¶ 26 [subcontractor responsible for tile work].)
Defendants contend that they discovered the basis for their proposed cross-claims during the deposition of Wysong. (Kharazmi Decl. ¶ 4.) Although defendants do not state when the deposition took place, there is no evidence that defendants are acting in bad faith in moving to assert cross-claims against Wysong and Lazarof at this stage in the litigation. Further, plaintiff does not oppose the motion or assert any reason why the Court should find bad faith on the part of defendants.
Defendants R.E. Gardinier Jr. Design + Construction, Inc. and Robert E. Gardinier are ordered to file their Cross-Complaint within three court days of this ruling.
