The parties participated in an IDC on 12/04/19. At the conclusion of the IDC, the Court issued a minute order indicating all issues were resolved, and Plaintiff was to take the motion off calendar upon receipt of further responses. The Court was originally scheduled to hear these motions to compel on 12/19/19. Prior to the hearing, the Court issued an order taking the motions off calendar because all issues had been resolved at the IDC. Both attorneys appeared at the hearing, and at the conclusion of the hearing the Court continued the matter to 1/27/20.
Neither party has filed any further brief concerning what issues remain unresolved at this time. The Court therefore continues the hearing again. The hearing is continued from 1/27/20 to Thursday, 2/27/20 at 10:00 a.m. in Department 31 of the Spring Street Courthouse. The Court orders the parties to file a joint statement of items in dispute at least one week prior to the continued hearing date. Pursuant to the newly-enacted CCP §§2023.300, 2031.310, and 2033.290, if the statement would otherwise be voluminous, the Court asks the parties to provide a concise outline of matters remaining in dispute rather than a joint statement.
The Court notes that trial is not scheduled until 5/21/20, and therefore time remains to resolve the issues relating to the MTCF prior to trial. The Court urges the parties to continue to meet and confer to resolve any remaining issues without the need for an additional hearing if at all possible.
Plaintiff is ordered to give notice.
