RELIEF REQUESTED: Reconsideration of the Court’s 7/27/20 ruling granting Plaintiff’s Motion for Leave to Amend Complaint.
RULING: The motion is denied.
Defendant Dorene Robinson makes this motion for reconsideration based on CCP 1008 and CCP 473. Defendant claims that she did not receive notice of the underlying motion for leave to amend until 7/16/20 and, therefore, did not have 9 court days to file her opposition. However, Defendant fails to explain why she did not receive timely notice of the 7/27/20 hearing date. (See Motion p.2:6-8, p.5:14-16, p.10:6-7; Robinson Decl. ¶15). The motion for leave to amend was served on Defendant on 3/11/20 for the original 4/13/20 hearing date. (See Proof of Service attached to Motion to Amend filed on 3/11/20). Thereafter, on 3/23/20, the Court served Defendant with notice that the hearing date was continued to 7/27/20. (See 3/20/20 Minute Order and 3/20/20 Certificate of Mailing). As such, Defendant has failed to establish that she failed to timely file an opposition to the motion for leave to amend due to mistake, inadvertence, surprise or excusable neglect. Therefore, Defendant is not entitled to relief under CCP 473(b).
With regard to Defendant’s request for relief under CCP 1008, Defendant has failed to establish that she has presented new or different facts, circumstances or law which warrant reconsideration of the Court’s 7/27/20 ruling. See CCP 1008(a). Defendant appeared at the 7/27/20 hearing and filed an opposition to the motion to amend that day. Despite the foregoing, the Court still granted the motion to amend.

MOTION FOR LEAVE TO FILE FIRST AMENDED COMPLAINT

RELIEF REQUESTED: An order granting leave to file a First Amended Complaint which dismisses Erik L. Lassman as Plaintiff without prejudice; dismisses all causes of action in the original complaint without prejudice; adds new Plaintiff Dewelt, LLC and adds three new causes of action for (1) Quiet Title; (2) Reformation of Deed; and (3) Declaratory Relief.
RULING: The unopposed motion is granted. Plaintiff must separately file the First Amended Complaint and cannot rely on the copy attached as Exhibit A to motion. Plaintiff must also properly serve the First Amended Complaint on the registered agent for the active Road Runner Land & Homes, LLC.
Due to the liberal policy of allowing leave to amend and lack of undue prejudice to Defendants, the motion is granted. However, Plaintiff must properly serve the First Amended Complaint on the registered agent for the active Road Runner Land & Homes, LLC. Plaintiff has no evidence to support its conclusion/allegation that the name Road Runner Land & Homes, LLC has been acquired by a third party who has no family or business relationship to the Defendant Road Runner Land & Homes, LLC and Defendant Dorene Robinson. (See Proposed FAC ¶15; Oronsaye Decl. ¶¶5-12).
