Plaintiff, Delvin Obando filed this action against Defendants, James Peter Stewart and Jimmy Stewart Trucking for damages arising out of an automobile accident. Plaintiff filed the complaint on 2/21/17. Plaintiff has not, to date, filed proof of service of the summons and complaint on Defendants. On 8/07/18, the Court called the matter for an FSC. Because Defendants had not been served, the Court set an OSC re: proof of service and trial setting conference for 11/09/18. On 11/09/18, Plaintiff appeared at the OSC and indicated the case had settled. The Court ordered Plaintiff to file a notice of settlement within fifteen days and scheduled an OSC re: dismissal for 5/23/19. On 5/23/19, Plaintiff filed a notice of settlement of the entire case. The same day, the Court held the OSC; because Plaintiff failed to appear, the Court dismissed the case.
At this time, Plaintiff moves to set aside the dismissal. Plaintiff’s attorney declares the failure to appear at the OSC was due to a calendaring error in her office. The motion is conditionally granted. CCP §473(b). The Court will grant the motion if and only if Plaintiff’s attorney appears and explains the status of the settlement, which has been pending since at least 11/09/18, over a year ago. If Counsel does not appear and explain the status of the settlement, the motion will be denied.
The Court also wishes to hear from Counsel concerning the status of service of the action on Defendants; the action has been pending since 2/21/17, two and a half years ago.
