Plaintiff, Rene Leon, a minor by and through his GAL, Christina Leon, filed this action against Defendant, ICES Education, LLC for damages.
Plaintiff, by and through his GAL and attorney, has agreed to settle this action with Defendant for the total amount of $120,000. If approved, $30,000 will be used for attorneys’ fees, $8006.81 for medical expenses, and $6181.96 for costs of suit. Petitioner proposes to place the net settlement amount of $75,811.23 in a blocked account.
The petition is denied without prejudice for the following reasons:
¶6 insufficiently describes the incident that forms the basis of the lawsuit;
¶7 insufficiently details the injuries sustained in the accident;
Petitioner failed to attach Plaintiff’s medical records as Attachment 9;
Petitioner failed to use the “outlines” feature to virtually tab the exhibits to the petition in eCourt. This feature allows the Court to easily review voluminous attachments, and complies with CRC 3.1110(f).
Petitioner is ordered to give notice.
Parties who intend to submit on this tentative must send an email to the court at sscdept31@lacourt.org indicating intention to submit on the tentative as directed by the instructions provided on the court website at www.lacourt.org. If the department does not receive an email indicating the parties are submitting on the tentative and there are no appearances at the hearing, the motion may be placed off calendar. If a party submits on the tentative, the party’s email must include the case number and must identify the party submitting on the tentative.
