Defendant Benny J. Kirk aka Tzu Ping Ko’s motion to stay action is GRANTED.
Under Code of Civil Procedure section 410.30, whenever a court finds that in the interest of substantial justice an action should proceed in another forum, it shall stay or dismiss the action in whole or in part on any conditions that may be just. (CCP, § 410.30, subd. (a).) The trial court has “fundamental inherent equity, supervisory, and administrative powers, as well as inherent power to control litigation before [it]” where there is no legal authority dictating how that power must be executed. (See Rutherford v. OuIens-Illinois, Inc. (1997) 16 Cal. 4th 953, 967; see also Code of Civ. Proc. §§ 187, 128(a); see also Thomson v. Continental Ins. Co. (1967) 66 Cal.2d 738, 746.) Under Pacers, Inc. v. Superior Court, the court has discretion to issue a stay of civil cases where defendants are also implicated in parallel criminal proceedings. (Pacers, Inc. v. Superior Court (1984) 162 Cal.App.3d 686, 690 (applying federal practice permitting stay of discovery and proceedings if both civil and criminal proceedings arise out of the same or related transactions to California law).)
The present case was filed on August 27, 2017. On or about June 13, 2019, a felony criminal complaint was filed against Defendant Benny J. Kirk aka Tzu Ping Ko (“Defendant”) based on the same or similar allegations as this action, and Defendant was arraigned on August 20, 2019.
Thus, it is in the interest of substantial justice to stay the civil case. Under Pacers, Defendant has a privilege against self-incrimination under the Fifth Amendment, a constitutional right which this lawsuit may compel Defendant to violate. The prejudice to Defendant far outweighs the prejudice, if any, to Plaintiffs.
The Motion to stay action as to Defendant is GRANTED. All future hearings are vacated.
