TENTATIVE ORDER
Defendant RAAM Construction, Inc. moves for attorney’s fees in the sum of $72,805.50, and costs in the sum of $1,378.95 per CC § 1717.
In any action on a contract, where the contract specifically provides that attorney's fees and costs, which are incurred to enforce that contract, shall be awarded either to one of the parties or to the prevailing party, then the party who is determined to be the party prevailing on the contract, whether he or she is the party specified in the contract or not, shall be entitled to reasonable attorney's fees in addition to other costs. (CC § 1717(a).)
Contrary to Movant’s contention that the contract contains a “prevailing party attorneys’ provision” (Motion, 3:22-24), there is no “prevailing party attorneys’ provision” in the contract. The attorney’s fees provision appears in the Indemnity paragraph, which states: “7. Indemnity. To the maximum extent permitted by law, Subcontractor shall indemnify defend and save harmless Owner, Prime Contractor… of and from any and all claims, demands, causes of action, damages, costs, expenses, actual attorneys’ fees, losses or liabilities, in law or inequity of every kind and nature whatsoever arising out of or in connection with Subcontractor’s operations to be performed under this Agreement.”
The Subcontractor agreed to indemnify the Contractor from third party claims (including actual attorneys’ fees) over the work performed.
The court could not locate any provision specifically granting attorney’s fees to the “prevailing party” for claims between the parties. The court will hear from the attorneys at the hearing.
