[TENTATIVE] ORDER RE: PLAINTIFF’S MOTION TO SET ASIDE DISMISSAL

On May 5, 2016, Plaintiff Michaela Sheppard filed this action against Defendants Century Transportation Services and West Coast Ambulance, Inc.
On August 6, 2018, the Court approved an application for determination of good faith settlement between Plaintiff and Defendant West Coast Ambulance, Inc.
On September 5, 2018, Plaintiff filed a notice of unconditional settlement of the entire case.
On December 19, 2018, Plaintiff filed her § 998 offer that Defendant Century Transportation Services, Inc. accepted.
On May 6, 2019, no appearances were made by or for any party for an Order to Show Cause Re: Dismissal and the Court ordered the Complaint dismissed without prejudice pursuant to California Rule of Court 3.1385.
On August 10, 2020, Plaintiff filed this motion to set aside the Court’s dismissal pursuant to Code of Civil Procedure § 473(d). Plaintiff’s counsel declares that he did not appear at the May 6, 2019 OSC because he believed the case was closed and the minute order on the dismissal was mailed to his previous office address. (Hosharian Decl., ¶¶ 5-6.) Plaintiff argues the Motion should be granted so that the Court may retain jurisdiction over the judgment against Defendant Century Transportation Services, Inc.
Section 473(d) states: The Court may, upon motion of the injured party, or its own motion, correct clerical mistakes in its judgment or orders as entered, so as to conform to the judgment or order directed, and may, on motion of either party after notice to the other party, set aside any void judgment or order.”
Plaintiff has shown no evidence of a clerical mistake or any void judgment or order. No proposed judgment was concurrently filed with the Notice of 998 offer. The 998 offer states that Plaintiff will file a dismissal with prejudice of this entire action if the offer is accepted.
Plaintiff’s Motion is DENIED.
