Plaintiff Justin Andrew Broussard Jr., through his guardian ad litem Dimitri Franklin (“Plaintiff”), moves to enforce the settlement agreement between Plaintiff and Defendant Rigoberto Aragon Zarate (“Defendant”). Code of Civil Procedure section 664.6 provides that “[i]f parties to pending litigation stipulate, in a writing signed by the parties outside the presence of the court or orally before the court, for settlement of the case, or part thereof, the court, upon motion, may enter judgment pursuant to the terms of the settlement.” (Code Civ. Proc., § 664.6.) In ruling on a motion to enter judgment, the Court acts as a trier of fact. The Court must determine whether the parties entered into a valid and binding settlement. To do so, the Court may receive oral testimony in addition to declarations. (Kohn v. Jaymar-Ruby, Inc. (1994) 23 Cal.App.4th 1530, 1533.)
In this case, Plaintiff and Defendant entered into a settlement agreement on February 10, 2017, which the Court approved on July 31, 2018. It provides that Defendant would pay Plaintiff $5,500. (Declaration of Shant L. Vayvayan, Exhibit A.) Plaintiff has received $5,000 of the settlement amount, but the check for the remaining $500 was dated January 20, 2017, although Plaintiff did not receive it until October 18, 2018. The bank therefore rejected the check as stale. Per the terms of the settlement agreement, Defendant owes Plaintiff the amount of $500. Defendant did not oppose the motion. Therefore, the Court enters judgment in favor of Plaintiff in that amount.
CONCLUSION AND ORDER
Plaintiff’s motion to enforce settlement is granted per Code of Civil Procedure section 664.6. Judgment is entered in favor of Plaintiff and against Defendant in the amount of $500. Plaintiff shall provide notice and file proof of such with the Court.
