Defendant Wendy Santiago’s Motion to Set Aside Default is DENIED.

  1. MOTION TO VACATE DEFAULT

“The court may, upon motion of the injured party, or its own motion, correct clerical mistakes in its judgment or orders as entered, so as to conform to the judgment or order directed, and may, on motion of either party after notice to the other party, set aside any void judgment or order.” (Code Civ. Proc., § 473, subd. (d).)

Wendy moves to vacate the default entered against her on May 24, 2019. The basis for the motion is unclear. The motion seeks relief under Code of Civil Procedure § 473, subd. (d), which allows for the setting aside of void orders. But there is no basis in the motion for finding the default entered against Wendy void. She says it is void because the court lacked personal jurisdiction over her, yet the verified proof of service of summons filed on May 24, 2019, states that substitute service was accomplished upon Wendy’s husband at her address on March 3, 2019. Wendy offers no reason to doubt the attestations contained in the proof of service.

Wendy goes on to argue that the claims against her are substantively defective, citing statutes preventing unlicensed real estate brokers from suing in collections actions for brokerage services. (Motion at pp. 3–4.) But this argument has no evident application to the facts of this case, and in any event this argument provides no basis for relief from an otherwise proper default.

Wendy finally argues that the motion may be granted based on the court’s inherent power to set aside orders grounded on fraud. (Motion at pp. 6–7.) But there is no basis presented to find that the default was obtained fraudulently.

The motion is DENIED.
