PLEASE TAKE NOTICE that on April 27, 2016 at 3:30 p.m., in Courtroom 502 of the above entitled court, located at 1130 “O” Street Fresno, California, Plaintiff, James M. Lanier will move to oppose Defendant San Joaquin Valley Officials Association’s (hereinafter “SJIVOA”) Demurrer to Plaintiff” Second Amended Complaint. |

This action is in opposition to Defendant San Joaquin Valley Officials Association

(SJVOA) Motion to Set Aside Default and Default Judgment.

| CASE HISTORY

(1) Plaintiff was granted pefrhission, pursuant to CRC 391(a) and CCP section 1019.5(aj, to file his Second Amended Complaint (SAC) on February 4, 2015 by Judge Mark W. Snauffer.

(2) Plaintiff filed his SAC on February 18, 2015 and processed service on Defendants by mail to Fred Broad, President of STVOA Board of Directors and Agent for Service for STVOA Board of Directors and Sheldon Feigel, former attorney

(3) Defendants failed to respond to Plaintiff’s SAC within the designated time limit for responding to a complaint.

(4) Oral arguments were heard in this Court on February 24, 2016 regarding Defendants Motion to Set Aside Default and Default Judgment. |

(5) Plaintiff presented Judge Snauffer, during those oral arguments, with informative evidence of Defendants deliberate failure to respond to all Court hearings, CMC’s and responsive documentation from January 14, 2014 to October 2015 when Defendants obtained new counsel.

(6) Defendants filed demurrer to Plaintiff’s SAC on March 24, 2016.

FACTS CONCERNING Ti—IE NATURE OF THIS DISPUTE

Plaintiff has uncovered new additional evidence of Defendants deliberate efforts to igfiore all court hearings and documentation. |

Plaintiff has been waiting for a ruling from Judge Snauffer, which Judge Snauffer took under advisement, since the oral arguments were presented on February 24, 2016 regarding this cases’ default status. Defendants attorney has prematurely filed this demurrer to Plaintiff’s SAC and for the reasons sét forth, Plaintiff respectfully requests that the Defendants’ Demurrer to Plaintiff’s Second | Amended Complaint be denied. f |

CONCLUSION

Plaintiff, in the interim, respectfully request this Courts permission to withhold his full opposition to Defendants Demurrer documentation until Judge Snauffer rules on the oral arguments from February 24, 2016 and rules on Plaintiff’s Motion to Reinstate Default and Reconsider Default Judgment on April 27, 2016. |
